Terms of Service

These terms govern the consulting services, free access to Keepsake, voluntary one-time contributions, and optional monthly supporter subscriptions offered through UngaBunga. By engaging us, supporting development, or using Keepsake, you agree to these terms.

Who we are

UngaBunga is the trading name of Dmytro Yankovskyi, a sole proprietor registered in the Czech Republic under IČO 29984734, with a registered address at Vysočanská 237/101, 190 00, Praha 9 - Střížkov, Czech Republic.

You can contact us at dizzzmas.dev@gmail.com.

What these terms cover

These terms apply to:

  • software consulting and related professional services;
  • access to Keepsake, which is currently free during early access;
  • voluntary one-time contributions made to support product development; and
  • optional monthly supporter subscriptions.

If a separate written agreement, statement of work, or order form covers a particular engagement, that document takes precedence over these terms to the extent of any conflict.

Consulting services

We provide consulting services on the basis of a written proposal, statement of work, or email confirmation that describes the scope, deliverables, timeline, and fees.

Unless agreed otherwise:

  • the client provides timely access to the people, systems, and information needed to perform the work;
  • work is performed remotely;
  • estimates are good-faith estimates, not guarantees;
  • either party may request a change in scope, and any change may affect the timeline and fees; and
  • the client is responsible for reviewing deliverables and giving feedback within a reasonable time.

Product access and contributions

Keepsake is currently free to use during early access. Features, limits, and availability may change while it is under development. No paid plan is required to use Keepsake.

One-time contributions are voluntary. They are not payment for a specific deliverable or feature, do not create a subscription, and do not entitle the contributor to additional features or support.

Supporter subscriptions are optional recurring payments that help fund development. The subscription is $10 per month and is charged automatically each month until cancelled. A supporter subscription does not unlock paid features or guarantee specific benefits today. We may add supporter benefits later; any material changes will be published before they take effect.

You can cancel a supporter subscription at any time using the subscription management link in your Stripe receipt or by emailing us. Cancellation stops future charges; it does not automatically refund the current billing period. Refunds and cancellations are described in our Refund & Supporter Policy.

We may suspend or end access if an account is used in breach of these terms or if required by law.

Accounts and acceptable use

You are responsible for the activity under your account and for keeping your login credentials secure.

You must not:

  • use the services in a way that is unlawful or infringes the rights of others;
  • attempt to gain unauthorised access to our systems or another customer’s data;
  • interfere with the operation or security of the services; or
  • resell or redistribute Keepsake except as expressly permitted by a separate agreement or licence.

Fees, taxes, and payment

Amounts are shown in the currency displayed at checkout or on the relevant invoice. Unless stated otherwise, amounts are exclusive of VAT and other applicable taxes. Where VAT applies, it is added at checkout.

Consulting fees are payable according to the relevant proposal or invoice. One-time contributions are charged when you make them. Supporter subscriptions renew automatically each month at the amount shown at checkout until cancelled; the billing interval and cancellation terms are shown before you confirm.

Payments are processed by Stripe. We do not receive or store your full payment card details. By making a payment, you also agree to Stripe’s applicable terms and privacy policy.

If an invoice is overdue, we may pause work or suspend access after giving you reasonable notice.

Contributions and refunds

One-time contributions, supporter subscriptions, cancellations, and consulting refunds are described in our Refund & Supporter Policy. Nothing in these terms limits any statutory rights you may have as a consumer.

Intellectual property

Each party retains ownership of the materials, data, and intellectual property it already owned or independently develops.

Upon full payment for a consulting engagement, the client receives ownership of the specific deliverables created for that engagement, except for pre-existing materials, reusable components, and third-party materials. We retain ownership of our general know-how, methods, and tools.

Keepsake is licensed, not sold. Subject to compliance with these terms, you receive a limited, non-exclusive, non-transferable right to use Keepsake for your own internal purposes while you have access to it. Open-source components remain subject to their respective licences.

Confidentiality

Each party will keep the other party’s non-public information confidential and use it only to perform the engagement or provide the services. This does not apply to information that is public, independently developed, or lawfully received from a third party, or to disclosures required by law.

Availability and changes

We aim to keep Keepsake available and reliable, but we do not promise uninterrupted service unless a separate written agreement says otherwise. Maintenance, security work, and third-party outages may cause downtime.

We may update these terms from time to time. The version published on this page applies from the date shown at the top. Material changes will be communicated by email or in the product before they take effect.

Liability

To the maximum extent permitted by law:

  • the services and Keepsake are provided without warranties beyond those expressly stated in these terms;
  • we are not liable for indirect, incidental, special, or consequential losses, or for lost profits, revenue, data, or goodwill; and
  • our total liability arising out of or in connection with the services is limited to the fees you paid to us in the twelve months before the event giving rise to the claim.

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for fraud, wilful misconduct, death or personal injury, or mandatory consumer rights.

Termination

You may stop using Keepsake at any time and may cancel a supporter subscription as described above. We may terminate or suspend access for material breach, non-payment where applicable, or unlawful use.

Provisions that by their nature should survive termination — including payment obligations, intellectual property, confidentiality, and liability — will continue to apply.

Governing law and disputes

These terms are governed by the laws of the Czech Republic, without regard to conflict-of-law rules. Subject to any mandatory consumer protections, disputes will be handled by the competent courts of the Czech Republic.

If you are a consumer in the European Union, you may also be entitled to bring proceedings in the courts of your country of residence. Czech consumers can contact the Czech Trade Inspection Authority (ČOI) for information about out-of-court consumer dispute resolution.
